MBA Admissions Services – Agreement 


This agreement is made by Manhattan Review, India with registered office located at 3-6-271, Sudheer Tapani Towers, # 402, Himayatnagar, Hyderabad – 500 029, hereby referred to as “MR”

AND

The student registered for the services offered by MR, which include Short listing of Universities and/or Editing of Essays, Letters of Recommendation, hereby referred to as “Client”.

The client agrees that he/she is paying ONLY for the services rendered by MR and/or its consultants and the fee paid does not cover the cost of mailing applications if applicable or the application fee to apply to a university or school or the GMAT score reporting fee.

Section ONE:

Shortlisting hereby referred to as “AS” of universities offered by MR:

MR provides “AS” to interested students who register for the said service.
  1. The client will be sent a soft copy of the Client Profile Form (CPF) by email upon registering for the service. This email will be sent automatically within 48 hours of registration. It is the client’s responsibility to check the spam folder and/or adjust the settings of the email to make sure that he/she is in possession of the CPF sent by MR.
  2. The email will be sent from support@indiamr.com and the client should add this email address as a safe email address to ensure that the emails sent by MR do not go to the spam folder. If the client does not receive the email for any reason, the client cannot hold MR responsible for any delay caused in the process of the services registered for. It is the responsibility of the client to follow up with MR on the non-receipt of the CPF, so that MR can send it manually to the client.
  3. The client will complete the CPF in its entirety and upload the soft copy of the same into the web portal used by MR. The web portal used as on the date of this agreement is http://www.editapplication.com or http://118.139.166.193
  4. Shortlisting of universities will be completed within 7 to a maximum of 10 business days. Saturdays and Sundays are not considered business days. If MR needs any clarification on the CPF and an email communication happens between MR and the client then the number of days lost during the communication will be added to the promised 7-10 days turnaround time. MR cannot be held responsible for any delay that may be caused due to unavoidable circumstances such as but not limited to, inaccurate information in the CPF, non-availability of the client over the telephone or email for any clarifications that may be required by MR.
  5. The client will be given a list of universities that match his/her profile as per the details mentioned in the CPF. Although every effort is taken to ensure that the information provided by the client is taken into consideration, it is possible that changes may be required in the list of schools provided if the list is not based totally on the information provided by the client in the CPF. In such case MR will revise the school(s) that is(are) deemed inaccurate and resend the revised list of schools to the client within 5 business days.
  6. The list will comprise of no more than six universities that the client has a possibility of getting an admission into. The list is broken down into dream, best fit, and reach schools. Dream schools are those schools that the client has a low chance of getting an admission into. However, the chances can be improved if the client is able to present a strong application to the school. Best-fit schools are those schools that the client has a decent chance of getting an admission into provided the profile of the client is good enough. Reach schools are those schools, where the client has a greater chance of getting an admission from the school.
  7. MR recommends a list of 2 dream schools, 2 best-fit schools and 2 reach schools. IF the client likes a different proportion of the list, then the client will have to clearly state that in the CPF. Failing to do so will force MR to follow the standard recommendation of 2 dream, 2 best fit and 2 reach schools.
  8. The client has 72 hours to respond to the recommended list of schools with any questions. After 72 hours, if the client does not respond, then MR will consider the process complete and a revision to the list or any questions on the list emanating after the 72 hour period will not be entertained.
  9. The number of times a client can ask a question on the list of schools recommended is limited to 3. This is only for a clarification or any question that the client may have. MR will not revise the list of schools or provide a new list of schools during this communication except if the circumstances fall under clause 5 of section one of this agreement.
  10. The list of universities suggested is entirely based on the information provided in the CPF. Any errors in the CPF will lead to an incorrect list of universities. After the CPF is sent to MR any changes or corrections to the CPF will not be entertained. MR will not be responsible for the resulting list of suggested universities caused by erroneous information in the CPF.
  11. If the client provides a projected score for GMAT® then “AS” will be processed based on that score. If the client gets a different score in the actual test than the projected score, then the student will have to register for “AS” again in order for MR to process “AS” with the revised score.
  12. The list of universities suggested is purely and completely based on the information provided by the client in the CPF. MR cannot guarantee an admission into any of the recommended universities as the consultant’s of MR will complete the process based on the information available on a university from the previous year(s).
  13. To the maximum possible extent MR will process the service based on the latest and current available information but a drastic change in the admissions criteria of a particular university cannot be estimated.
  14. No communication between the client and the consultant of MR will be entertained.
  15. The mode of communication on the service is through the web portal ONLY.
  16. Registering for the AS service does not guarantee an admission into a university or school.
  17. There will be no refunds for the services registered for under any circumstances and no communication on this subject will be entertained no matter what the ground for requesting a refund is.
  18. Registration is not transferable to any other client.
  19. Either party to this agreement shall be excused from any delay or failure in performance hereunder caused by reason of any occurrence or contingency beyond its reasonable control, including but not limited to, acts of God, earthquake, labor disputes and strikes, riots, war, and governmental requirements. The obligations and rights of the party so excused shall be extended on a day-to-day basis for the period of time equal to that of the underlying cause of the delay.
  20. Any claim, dispute or controversy with respect to, in connection with or arising out of this Agreement shall be subject to and decided by arbitration in the jurisdiction of Hyderabad, by an arbitrator appointed by MR
  21. MR may without advance notice amend this Agreement from time to time, and will do so by posting the new Agreement on the website in place of the old agreement. Each and every such amendment shall be become effective immediately for all pre-existing and future accounts. It is your responsibility to periodically check the website for updates of this Agreement.
  22. If any term, clause or provision hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term, clause or provision and such invalid term, clause or provision shall be deemed to be severed from the Agreement.
  23. The client agrees to fully defend and indemnify and hold harmless MR of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including lawyer’s fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any breach or claim of breach of this agreement or your negligence whether active or passive or any negligence of MR in any way related to your use of the Services offered by MR or any portion thereof.
  24. The client agrees to fully defend and indemnify and hold harmless MR of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including lawyers fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any violation or claimed violation.

Section TWO:

Editing Services hereby referred to as “ES” offered by MR

  1. MR provides “ES” to students who approach and register with MR for the said service.
  2. Registering for “ES” does not guarantee an admission into a university or school.
  3. For a package pricing involving editing services for more than one university, the editing service will begin after the total amount is paid with no balance due.
  4. The client will upload a soft copy of the draft of the essay or the Letter of Recommendation in a word document format.The web portal currently being used http://www.editapplication.com or http://118.139.166.193
  5. The client WILL NOT upload all the essays in a single document. If the client does so, then the client will be asked to resubmit the essays.
  6. The client will upload the essays to the site at least 10 days before the application deadline of the university or school.
  7. If the client uploads the documents to MR with less than 10 days to spare before the deadline, MR may not be able to deliver the edited documents by the deadline. In the unfortunate event of this happening, the client may have to avail the services for the same university for another intake and for the same admissions year as the services are not transferrable to another university or another year of admission. If the client misses the deadline for that year, then it will result in forfeiture of the amount paid towards the services.
  8. The average turnaround time for the edited versions of the essays to be sent back to the student is three business days. Saturday and Sunday are not considered business days. Documents will be sent back to the students from the web portal used.
  9. The email will be sent from support@indiamr.com and the client should add this email address as a safe email address to ensure that the emails sent by MR do not go to the spam folder. In case the client does not receive the email for any reason, the client cannot hold MR responsible for the delay caused by this. It is the responsibility of the client to follow up with MR so that MR can manually send the documents if necessary.
  10. Track change feature of MS Word is used for editing. The client will receive the edited document with changes that the client SHOULD accept or reject before uploading the revised version to the web portal.
  11. Track change feature of the document SHOULD NOT be removed by the client. If the client does remove the track change feature, then MR may work on the document with the track change feature turned off due to which, the changes made in the document will not be available to the client.
  12. The maximum number of edits that will be done on a document is three (3) for regular editing services and for premium editing services the maximum number of edits that will be done on a document is five (5). To illustrate, a student will upload the first version of the document and MR will return the second version of the document. The client will upload the third version of the document and MR will work on the changes and send the fourth version of the document back to the student. The client will upload the fifth version of the document and MR will work on the changes and send the sixth version of the document back to the student at which time it is understood that the editing is complete for that particular document. For clients registering for premium service, the editing will be deemed complete when the tenth version of the document is sent back to the client.
  13. The clients registering for premium service will get a one hour of brainstorming session over the phone with the consultant of MR. The client can choose to use this one hour for up to a maximum of two slots of half an hour each or one slot of one hour.
  14. The word count of the draft of the essays should not exceed by more than a 100 words than what the actual word count of the essay should be. If the essay word limit is 500 words, then the client should send the essays with more than 600 words.
  15. MR will NOT reduce the word count to meet the word limit requirement of the essay. MR will primarily do editing of the document and not word count reduction as the choice is left to the client to remove parts of the essay that he/she feels are unnecessary, as trimming of the words done by anybody other than the author will result in tampering the structure and the content of the edited document.
  16. No communication between the client and the consultant of MR will be entertained. For students registering for Premium services, the mode of communication with the consultant of MR is over telephone for the brainstorming session ONLY. Once the brainstorming session is complete, the mode of communication on the remaining aspects of the service is through the web portal ONLY.
  17. The mode of communication between the clients registering for regular service and the consultant of MR is through the web portal ONLY
  18. A client registered for the services for a particular year of admission may NOT transfer the service to another year of admission.
  19. However the client may at his or her will transfer the services to another school or university with the same number of essays and with a similar word count limit for the same year of admission.
  20. Registration is not transferable to any other client.

  25. If any term, clause or provision hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term, clause or provision and such invalid term, clause or provision shall be deemed to be severed from the Agreement.
  26. The client agrees to fully defend and indemnify and hold harmless MR of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including lawyer fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any breach or claim of breach of this agreement or your negligence whether active or passive or any negligence of MR in any way related to your use of the Services offered by MR or any portion thereof.
  27. You agree to fully defend and indemnify and hold harmless MR of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including lawyer fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any violation or claimed violation.
  28. The legal name for MR in India is CK’s Edvantage Education PVT LTD. All communication to MR should be made at its address mentioned above.
